Judge Kent Denied MetLife's Motion for Protective Order

In Jez v. Dow Chemical LTD Plan and MetLife, filed in Galveston, Texas, Judge Kent denied MetLife's Motion for protective order. I wanted to get information from Network Medical Review (NMR). NMR is an outfit of physicians that find disability claimants to be "not disabled." Thus NMR is used a lot by the insurance industry. I wanted to learn how often MetLife uses them.

Following Judge Kent's order I get to learn the following:

Please state the number of files that MetLife and its affiliated companies have referred to Network Medical Review and Network Medical Review affiliated companies or entities, including Elite Physicians Ltd., by year, how much MetLife and its affiliated companies pay for a review, and how much in total, by year, MetLife and its affiliated companies have paid to Network Medical Review and Network Medical Review affiliated companies or entities, including Elite Physicians Ltd.

3. Please produce all contracts and payments made to Tanya C. Lumpkins, M.D.

Dr. Lumpkins was the "independent" physician who found Ms. Jez to be not disabled.

From plaintiff's attorney in San Diego - Dr. Lumpkins also found my client to be "not disabled" despite overwhelming evidence to the contrary. Never examined claimant.
